  3. YOU CANNOT USE THIS SOFTWARE UNTIL YOU HAVE CAREFULLY READ AND 
  4. AGREED TO THE FOLLOWING TERMS AND CONDITIONS.  BY CLICKING ON THE 
  5. "YES" BUTTON, YOU ARE  CONSENTING TO BE BOUND BY THE TERMS OF 
  6. THIS AGREEMENT.  IF YOU DO NOT AGREE TO THE TERMS OF THIS

  17. License Agreement

  19. You should carefully read the following terms and conditions
  20. before using this software.  Unless you have a different license
  21. agreement signed by Lollop Software your use of this
  22. software indicates your acceptance of this license agreement
  23. and warranty.

  25. This software is protected by copyright law and international 
  26. copyright treaty.  Therefore, you must treat this software just 
  27. like a book, except that you may copy it onto a computer to be 
  28. used and you may make archive copies of the software for the 
  29. sole purpose of backing up our software and protecting your 
  30. investment from loss.  The software may be moved from one 
  31. computer to another, so long as there is no possibility of it 
  32. being used by more than one person at a time.

  34. ADDING USERS
  35. You may add users by paying for a separate software package for 
  36. each user you wish to add.  You may also add users by purchasing 
  37. a site-license, so long as the number of persons who are able to 
  38. use the software at one time is not more than the number of 
  39. authorized users specified in our package or license.

  42. EXAMPLE OF LICENSING
  43. This software is composed of 2 units. One unit is the Capture.exe
  44. program and the other is the Viewit.exe program. Each unit may be 
  45. installed on multiple machines so long as the total installations
  46. of either unit does not exceed the number of authorized users 
  47. specified in our package or license. Any questions about licensing
  48. should be addressed to Lollop Software.

  50. EXAMPLE NUMBER 1
  51. The Capture.exe program is installed on (one)1 machine while the 
  52. Viewit.exe program is installed on (twenty)20 machines. The required
  53. number of Capture Screen licensed users must meet or exceed twenty(20).

  56. The Capture.exe program is installed on (twenty)20 machines while the 
  57. Viewit.exe program is installed on (one)1 machine. The required
  58. number of Capture Screen licensed users must meet or exceed twenty(20).

  61. The Capture.exe program is installed on (twenty)20 machines while the 
  62. Viewit.exe program is installed on (twenty)20 machines. The required
  63. number of Capture Screen licensed users must meet or exceed twenty(20).

  65. TRANSFERRING THE SOFTWARE
  66. You may transfer all of your rights to use the software to 
  67. another person, provided that you transfer to that person all of 
  68. the software, diskettes (if applicable), and documentation 
  69. provided in this package (including this statement), and 
  70. transfer or destroy all copies in any form.  Remember, once you 
  71. transfer the software, you no longer have any right to use it, 
  72. and the person to whom it is transferred may use it only in 
  73. accordance with the copyright law, international treaty, and 
  74. this statement.

  76. Except as provided in this statement, you may not transfer, rent, 
  77. lease, lend, copy, modify, translate, sublicense, time-share, or 
  78. electronically transmit or receive the software, media, or 
  79. documentation.

  82. LIMITED WARRANTY

  84. Lollop Software warrants the package collection 
  85. file and online help file provided by Lollop Software to 
  86. be free of defects in materials (if provided on diskette) and 
  87. workmanship for a period of thirty (90) days from the original 
  88. purchase date.  If Lollop Software receives notification 
  89. within the warranty period of defects in materials or workmanship, 
  90. and determines that such notification is correct, Lollop Software 
  91. will replace the defective package collection file or 
  92. online help file.

  94. The entire and exclusive liability and remedy for breach of this 
  95. limited warranty shall be limited to replacement of defective 
  96. media or documentation and shall not include or extend to any 
  97. claim for or right to recover any other damages, including but not 
  98. limited to, loss of profit, data, or use of the software or 
  99. special, incidental or consequential damages, or other similar 
  100. claims, even if Lollop Software has been specifically 
  101. advised of the possibility of such damages.  In no event will 
  102. Lollop Softwares' liability for any damages to you or any 
  103. other person ever exceed the lower of the list price or the actual 
  104. price paid for the package or the license to use the software, 
  105. regardless of the form of the claim.

  107. LOLLOP SOFTWARE SPECIFICALLY DISCLAIMS ALL OTHER 
  108. WARRANTIES, REPRESENTATIONS, OR CONDITIONS, EXPRESS OR IMPLIED, 
  109. INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OR CONDITION OF 
  110. MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  ALL OTHER 
  111. IMPLIED TERMS ARE EXCLUDED.

  113. Specifically, Lollop Software makes no representation or 
  114. warranty that the software or documentation are "error-free," or 
  115. meet any user's particular standards, requirements, or needs.  In 
  116. all events, any implied warranty, representation, condition, or 
  117. other term is limited to the package collection file and online 
  118. documentation and is limited to the 90-day duration of the 
  119. limited warranty.

  121. GOVERNING LAW
  122.  
  123. This agreement shall be governed by the laws of the State of
  124. Michigan.

  127. EVALUATION VERSION AND REGISTRATION
  128.  
  129. This is not free software.  Subject to the terms of this license,
  130. you are hereby licensed to use this software for evaluation 
  131. purposes without charge for a period of 60 executions of the software.
  132. If you use this software after the 60 execution evaluation period a 
  133. registration fee of $35 is required. Please visit Lollop Software on 
  134. the web at http://www.macatawa.org/~spruitr for more information about
  135. registration.

  137. Unregistered use of Capture Screen after the 60 execution evaluation
  138. period is in violation of U.S. and international copyright laws.

  140. DISTRIBUTION

  142. Provided that you verify that you are distributing the Evaluation
  143. Version you are hereby licensed to make as many copies of the 
  144. Evaluation version of this software and documentation as you 
  145. wish; give exact copies of the original Shareware version to anyone; 
  146. and distribute the Shareware version of the software and 
  147. documentation in its unmodified form via electronic means.  There 
  148. is no charge for any of the above.
